1. Acceptance of Terms

By accessing or using FinanceDeck ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

FinanceDeck is a web-based debt management application that allows users to manually track credit card and line-of-credit accounts, view calculated payoff strategies, receive payment alerts, and export reports. The Service is provided "as is" and is intended for informational purposes only. FinanceDeck does not provide financial, investment, tax, or legal advice.

3. Account Registration

To use certain features of the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. User Responsibilities

When using FinanceDeck, you agree to:

• Provide accurate information when entering your financial data
• Use the Service only for lawful purposes and in accordance with these Terms
• Not attempt to access other users' accounts or data
• Not use automated systems (bots, scrapers, etc.) to access the Service without our permission
• Not introduce malicious code, viruses, or any harmful material
• Not interfere with or disrupt the Service or its infrastructure

5. Subscription and Payments

FinanceDeck offers a free tier and a paid Pro tier. The Pro tier provides additional features such as unlimited accounts, charts, a payoff simulator, and data export. Pricing is displayed on our Pricing page and may be changed with reasonable notice.

If you subscribe to the Pro monthly plan, you will be billed on a recurring monthly basis until you cancel. The yearly plan is billed annually at a discounted rate. You may cancel either plan at any time. Refunds are handled on a case-by-case basis at our discretion.

6. Intellectual Property

All content, features, and functionality of the Service -- including but not limited to text, graphics, logos, icons, software, and design -- are the exclusive property of FinanceDeck and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

FinanceDeck does not guarantee that the Service will be uninterrupted, error-free, or secure. Calculations, projections, and strategies provided by the Service are estimates only and should not be relied upon as financial advice.

8. Limitation of Liability

To the fullest extent permitted by law, FinanceDeck and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, or goodwill.

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or $50, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless FinanceDeck and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FinanceDeck operates, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
